1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of MindIntake’s websites, products, and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Who we are

The Service is operated by Artech Digital LLC (“MindIntake,” “we,” “us,” or “our”). Contact: artur@artech-digital.com.

3. The Service (administrative intake tool only)

The Service is intended to support administrative intake and pre-screening workflows. It is not a medical device and does not provide medical advice, diagnosis, treatment recommendations, or clinical decision-making. You are solely responsible for how you use the Service, including ensuring that all clinical decisions are made by licensed professionals.

4. Eligibility and authorized users

You must be at least 18 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

5. Accounts, access, and security

  • You are responsible for maintaining the confidentiality of your credentials.
  • You must promptly notify us of any unauthorized access or use.
  • We may suspend or terminate access to protect the Service or users.

6. Acceptable use

You agree not to:

  • Use the Service in violation of any law, regulation, or professional standard.
  • Attempt to interfere with or compromise system integrity or security.
  • Reverse engineer, decompile, or attempt to extract source code, except where prohibited by law.
  • Use the Service to generate or disseminate unlawful, harmful, or deceptive content.

7. Customer data, PHI, and compliance

You retain all rights to data you submit to the Service (“Customer Data”). You are responsible for ensuring you have the rights and permissions to provide Customer Data, including any patient information. Where applicable, the parties may enter into additional agreements (e.g., a Business Associate Agreement) to address HIPAA and protected health information (PHI) requirements.

8. Intellectual property

The Service, including its software, design, and branding, is owned by MindIntake or its licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use the Service.

9. Third-party services and links

The Service may integrate with or link to third-party services (e.g., scheduling providers). We are not responsible for third-party services, and your use of them is governed by their terms and policies.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INTAKEFLOW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

12. Indemnification

You agree to defend, indemnify, and hold harmless MindIntake from and against claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service, your Customer Data, or your violation of these Terms.

13. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will provide notice as required by law. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or if needed to protect the Service. You may stop using the Service at any time.

15. Governing law

These Terms are governed by the laws of the United States, without regard to conflict of laws principles.
